To survive and prosper in what may become the most severe real estate recession since the great depression, lenders, investors, developers, homebuilders and their respective financial and legal advisers will need to marshal their collective talents to devise creative investment strategies that exploit opportunities while mitigating the many financial perils facing the industry.

For consumers with spotty credit or corporations with overleveraged balance sheets, lower interest rates and liquidity injections by the Fed have not yet coerced lenders to loosen their purse strings.

Given the chaos in the current real estate market, almost any creative deal structure will need to be considered in order to clsoe deals that will inevitably involve multiple parties "sharing the pain."
